Please read this document carefully before registering or participating in any activity associated with Love Your Actual Neighbor or Project Porchlight. By submitting a registration form, participating in any event, or engaging with our programs, you agree to these terms in their entirety.
1. About Love Your Actual Neighbor and Project Porchlight
Love Your Actual Neighbor (“LYAN,” “we,” “us,” or “our”) is a registered Utah nonprofit corporation. Our mission is to help neighbors build real friendships and a sense of belonging in their local communities. We operate Project Porchlight, a community initiative currently active in Utah.
Project Porchlight operates through two distinct participant roles:
- Porchlight Homes: Neighbors who commit to participating in community activities, saying yes to invitations, and periodically sharing meals with neighbors.
- Block Builders: Neighbors who independently organize Block Events for their street and/or lead recurring Neighborhood Groups built around shared activities.
LYAN provides a platform, framework, resources, and limited financial support to facilitate neighbor-to-neighbor connection. LYAN does not itself organize, supervise, manage, or control individual community events, Block Events, or Neighborhood Group gatherings.
2. Nature of Activities: Independent Participant-Organized Events
IMPORTANT: Love Your Actual Neighbor does not organize, plan, supervise, direct, control, or manage any individual Block Events, Neighborhood Groups, block parties, meals, walks, or other gatherings that occur within the Project Porchlight framework.
All in-person activities — including but not limited to block parties, potlucks, neighborhood walks, fitness groups, book clubs, game nights, cooking groups, and any other gatherings — are organized, hosted, and managed independently by individual Block Builders or Porchlight Homes acting in their personal capacities as private individuals, not as agents, employees, volunteers, or representatives of LYAN.
LYAN’s role is limited to:
- Providing an online registration platform and community framework
- Supplying informational and organizational resources (e.g., event templates, invitation guides)
- Administering the Block Party Grant reimbursement program
- Maintaining a directory of participants for internal coordination purposes
- Offering general encouragement and program updates
By registering as a Porchlight Home or Block Builder, or by attending any event organized through Project Porchlight, you acknowledge and agree that LYAN is not the organizer of the activities you participate in, and that LYAN bears no responsibility for the planning, execution, safety, or outcomes of those activities.
3. Roles and Responsibilities of Participants
3.1 Porchlight Homes
Porchlight Homes are individual adults who voluntarily register to participate in community connection activities. By registering, a Porchlight Home agrees to participate in Neighborhood Groups and community events when available and invited, say yes to invitations from neighbors whenever reasonable, and periodically invite a neighbor to share a meal or beverage.
Porchlight Homes participate in all activities at their own discretion and risk. Porchlight Homes are not employees, contractors, agents, or representatives of LYAN. LYAN does not supervise, direct, or control the activities of Porchlight Homes.
3.2 Block Builders
Block Builders are individual adults who voluntarily agree to organize Block Events and/or lead Neighborhood Groups within their neighborhood. Block Builders act entirely in their own individual capacity and not as agents, employees, or volunteers of Love Your Actual Neighbor.
By registering as a Block Builder, you acknowledge and agree that:
- You are acting as an independent individual organizer, not as a representative or agent of LYAN.
- You are solely responsible for planning, organizing, hosting, and managing any Block Events or Neighborhood Groups you choose to conduct, including ensuring the safety of participants at your events.
- You are solely responsible for complying with any applicable city ordinances, HOA rules, permitting requirements, noise restrictions, or other local regulations related to gatherings at your property or on your street.
- You are solely responsible for any food safety practices, alcohol-related decisions (if any), and physical safety considerations at your events.
- LYAN does not review, approve, supervise, or take responsibility for how you organize or conduct events.
- Receipt of a Block Party Grant from LYAN does not create an employment, agency, or other legal relationship between you and LYAN, nor does it establish LYAN as a co-organizer or co-host of your event.
- You are strongly encouraged to ensure your homeowner’s or renter’s insurance provides adequate coverage for gatherings at or near your property.
4. Assumption of Risk
All participation in activities associated with Project Porchlight is entirely voluntary and at your own risk.
You acknowledge that participating in community activities, including but not limited to block parties, neighborhood walks, fitness groups, outdoor activities, cooking events, and any other gathering, involves inherent risks, including but not limited to:
- Physical injury from activities, accidents, or falls
- Property damage
- Illness, including communicable diseases
- Interpersonal conflicts or disputes between neighbors
- Food allergies or reactions from shared food at potluck-style events
- Risks associated with outdoor activities, weather, or environmental conditions
- Risks inherent in any physical or recreational activity
By registering or participating, you voluntarily assume all risks associated with your participation in any Project Porchlight-related activity, whether or not such risks are listed above.
5. Release of Liability and Indemnification
5.1 Release
To the fullest extent permitted by applicable Utah law, by registering as a Porchlight Home or Block Builder, or by participating in any Project Porchlight-related activity, you hereby release, waive, discharge, and covenant not to sue Love Your Actual Neighbor, its officers, directors, employees, volunteers, agents, successors, and assigns (collectively, the “LYAN Parties”) from any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your participation in any Block Event, Neighborhood Group, block party, meal, or any other activity associated with Project Porchlight
- Any act or omission of any Block Builder, Porchlight Home, or other participant
- Any injury, illness, property damage, or other harm you sustain in connection with any such activity
- Any dispute between neighbors arising in connection with the program
This release applies whether or not such claims arise from the negligence of LYAN, to the extent permitted under Utah law.
5.2 Indemnification
You agree to indemnify, defend, and hold harmless the LYAN Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site or your participation in Project Porchlight; (b) any event you organize as a Block Builder; (c) your violation of these Terms; or (d) your violation of any third-party rights or applicable law.
6. Disclaimer of Warranties
The Site and all LYAN programs, resources, materials, and services are provided on an “as is” and “as available” basis without warranty of any kind, express or implied. LYAN expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
LYAN does not warrant or represent that:
- The Site will be uninterrupted, error-free, or secure
- Any Block Builder or Porchlight Home will fulfill their commitments
- Participation in the program will result in any particular level of community connection, friendship, or personal benefit
- Events organized by Block Builders will be safe, well-organized, or free from harm
7. Limitation of Liability
To the fullest extent permitted by applicable Utah law, the LYAN Parties shall not be liable to you for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of the Site or your participation in any Project Porchlight activity, even if LYAN has been advised of the possibility of such damages.
In no event shall LYAN’s total liability to you for all claims arising out of or related to these Terms or your participation in the program exceed the total amount of any Block Party Grant funds received by you from LYAN in the twelve (12) months preceding the claim, or $100, whichever is greater.
8. Utah Nonprofit and Volunteer Protections
Love Your Actual Neighbor is a registered Utah nonprofit corporation. Under the Utah Charitable Immunity Act and the Utah Volunteer Protection Act, certain limitations on liability may apply to nonprofit organizations and their volunteers acting within the scope of their authorized activities. These Terms are intended to be interpreted in a manner consistent with and in addition to any protections afforded by applicable Utah law.
Block Builders and Porchlight Homes are not volunteers of LYAN within the meaning of any volunteer protection statute. They are independent individuals acting on their own behalf, and such statutory protections do not extend to their independent activities.
9. Age Requirement and Minors
Our programs and registration forms are intended for adults who are 18 years of age or older. By registering as a Porchlight Home or Block Builder, you represent and warrant that you are at least 18 years of age.
Minors (individuals under the age of 18) may participate in Project Porchlight activities (such as attending block parties) only under the direct supervision of a parent or legal guardian who accepts full responsibility for the minor’s participation and safety. The parent or guardian assumes all risks associated with the minor’s participation on the minor’s behalf. LYAN bears no responsibility for the safety or supervision of minors at any event.
10. No Employment, Agency, or Sponsorship Relationship
Nothing in these Terms or in your participation in Project Porchlight creates any employment, contractor, agency, partnership, joint venture, or fiduciary relationship between you and Love Your Actual Neighbor.
Block Builders are not employees, contractors, or agents of LYAN. The provision of a Block Party Grant does not constitute employment compensation or create any legal relationship beyond that of a grantor and a grant recipient. Block Builders have no authority to bind, represent, or make commitments on behalf of LYAN.
11. Participant Conduct
By registering with Project Porchlight, you agree to treat all neighbors, participants, and community members with respect and dignity. You agree not to use the Project Porchlight platform, participant directory, or contact information provided to you through the program to harass, threaten, solicit, spam, or otherwise harm other participants.
LYAN reserves the right to remove any participant from the program at any time, for any reason, at its sole discretion, including for conduct that we determine to be harmful, disrespectful, or contrary to our mission.
12. Dispute Resolution and Governing Law
These Terms and any dispute arising out of or related to them or your participation in Project Porchlight shall be governed by the laws of the State of Utah, without regard to its conflict of law principles.
In the event of any dispute between you and LYAN, you agree to first attempt to resolve the dispute informally by contacting us at outreach@loveyouractualneighbor.org. If the dispute cannot be resolved informally, both parties agree to submit to the exclusive jurisdiction of the state or federal courts located in Utah County, Utah.
To the fullest extent permitted by law, you waive your right to participate in any class action lawsuit or class-wide arbitration against LYAN.
13. Changes to These Terms
LYAN reserves the right to update or modify these Terms at any time. We will post updated Terms on our Site with a revised effective date. Your continued participation in Project Porchlight following any update constitutes your acceptance of the revised Terms.
14. Severability and Entire Agreement
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or, if modification is not possible, severed from these Terms, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Love Your Actual Neighbor regarding your participation in Project Porchlight and supersede all prior discussions, agreements, or understandings on the subject matter.
